REAL PEOPLE REAL ESTATE – PROMOTIONS & GIVEAWAYS TERMS AND CONDITIONS

1. Introduction

1.1. These Terms and Conditions apply to all competitions, promotions, and giveaways (hereafter referred to as “Promotions”) run by Real People Real Estate under the “Local Promotions and Giveaways” group.
1.2. By entering any Promotion, entrants agree to be bound by these Terms and Conditions.
1.3. Promotions are only open to residents of South Australia.
1.4. These Promotions are conducted in compliance with all relevant South Australian and federal laws, including:

• The Spam Act 2003 (Cth)
• The Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs)
• Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth)
• South Australia’s Trade Promotion Lottery Regulations
  1.5. Real People Real Estate reserves the right to modify, update, or change these Terms and Conditions at any time. Any changes will be communicated in writing to participants through appropriate channels.
  1.6. Employees of Real People Real Estate, their immediate family members, and individuals residing in the same household as employees are not eligible to enter any Promotion.

2. Entry Requirements

2.1. To enter, participants must provide their full legal name as it appears on their driver's license or passport.
2.2. By opting into the “Local Promotions and Giveaways” group, entrants will be automatically entered into all future Promotions conducted by Real People Real Estate.
2.3. By entering, participants agree to receive communications from Real People Real Estate, including:

• Marketing/Newsletter Emails
• Matching Property Alert Emails
• SMS Messages
• Marketing Letters
  2.4. By entering a Promotion, participants explicitly consent to receiving marketing communications in accordance with the Spam Act 2003 (Cth). All communications will clearly identify Real People Real Estate as the sender and provide a functional unsubscribe option.
  2.5. Participants may unsubscribe from these communications at any time. However, if they opt out, they will be automatically removed from eligibility for any yet-to-be-drawn and future Promotions.
  2.6. Real People Real Estate reserves the right to retain basic participant data for compliance and auditing purposes in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles (APPs).
  2.7. Participants must be 18 years or older to enter any Promotion.
• Age-Restricted Prizes: Prizes such as alcohol, lottery tickets, or other legally age-restricted items will only be awarded to winners who meet the minimum legal age requirement.
• Proof of age must be provided with a valid photo ID (e.g., driver’s license, passport). If a winner is underage for a restricted prize, the prize will be redrawn.
  2.8. Competitions for Children (Under 18 Years Old):
• Where a competition is specifically for children, a parent or legal guardian must be listed as the primary point of contact on the entry form.
• Prizes will only be awarded to the adult and must comply with legal age restrictions (e.g., no alcohol, lottery tickets, or adult-themed items will be given to minors).
• The adult listed as the point of contact will be responsible for collecting and managing the prize on behalf of the child.
  2.9. Automatic Entry for Certain Promotions:
• If a Promotion only requires participant details (such as name and contact information), individuals who have previously provided their details will automatically be entered without needing to re-submit.
• If a Promotion requires a specific answer, guess, or interaction (e.g., "Guess the number"), automatic entry will not apply, and participants must actively submit their entry.
  2.10. Single Entry Rule for Guess-Based Promotions:
• For Promotions that require participants to guess a number or provide a specific answer, each entrant may only enter once.
• If a participant submits multiple guesses, only their last submitted entry will be considered.
• Any attempt to submit excessive entries or manipulate the system may result in disqualification.
  2.11. Shared Accounts & Duplicate Entries:
• Entries using sharded (shared or duplicate) emails, mobile numbers, or full names will be deemed to be shared accounts.
• Shared accounts and duplicate entries will be invalid, and such participants may be disqualified from the Promotion.
• Each entrant must use a unique email, phone number, and full legal name to ensure the integrity of the competition.

3. Prize Eligibility & Verification

3.1. Winners must provide a matching photo ID (driver’s license, passport, or other government-issued identification) within 72 hours of being notified. Failure to do so will result in a redraw.
3.2. The winner must prove South Australian residency with their provided ID. If they cannot, the prize will be redrawn.
3.3. Winners must take a photo with the giveaway item to confirm receipt.
3.4. For prizes valued over $150, Real People Real Estate staff will take a photo of the winner receiving the item for auditing purposes.
3.5. Real People Real Estate reserves the right to verify any participant's eligibility and disqualify entries that do not meet these requirements.

4. General Terms

4.1. Real People Real Estate reserves the right to modify, suspend, or terminate any Promotion at its discretion, in compliance with the Australian Consumer Law (ACL).
4.2. Entries that do not comply with these Terms and Conditions will be deemed invalid.
4.3. Prizes are not transferable, exchangeable, or redeemable for cash.
4.4. Any attempt to manipulate the entry process or breach these terms will result in disqualification.
4.5. If a Promotion qualifies as a Trade Promotion Lottery, Real People Real Estate will obtain necessary permits in accordance with South Australia’s Consumer and Business Services (CBS) requirements.

5. Privacy & Communication

5.1. By entering, participants agree to receive property updates and community-relevant information from Real People Real Estate.
5.2. Personal data collected will be used in accordance with Real People Real Estate’s Privacy Policy and applicable Australian and South Australian regulations.
5.3. Unsubscribing from marketing materials automatically revokes eligibility for future Promotions.
5.4. Real People Real Estate will not sell or share personal data with third parties, except where required by law or necessary for fulfilling prize obligations.
5.5. Participants can request access to or correction of their personal data in accordance with the Privacy Act 1988 (Cth) by contacting Real People Real Estate directly.

6. Governing Law

6.1. These Terms and Conditions are governed by the laws of South Australia.
6.2. Any disputes shall be subject to the jurisdiction of the courts of South Australia.
